Yes, it depends.
If you commission someone to make a map for you, the rights to the work you purchase should be negotiated with the artist. Most artistis will charge you more for the right to use their work commercially, then they would for just personal use.
There are quite a few different softwares in use by the people on this forum, and most of us who take commissions have the rights to use them commercially The community here is extremely varied, we have people using all kinds of software as well as traditional pen and paper to do our art. The easiest way would probably to either post a commission reques to designated subforum here, or approach artists directly if you already have an idea of who you'd want to work with.
